Fighting for Heather Ellis

Thank you for joining our Fight. Now please tell others about this injustice.

Below is text for an email you can cut and paste to forward onto others. You are, of course, welcome to write your own email if you wish.

To my fellow soldiers in the struggle for justice,

I am not sure if you are aware of the case of Heather Ellis, the young college student who may face 15 years in prison for cutting in line at Walmart. The facts in the case do not add up, given that she was only joining her cousin in line. This altercation should never have ended up with police being called and it certainly should not cost this young woman her future.

The Ku Klux Klan has gotten involved, threatening Heather and her family for their public protests of the incident. The events took place in a town near the one in which Rush Limbaugh was born, so there is a long history of injustice toward African Americans.

I have signed the petition with the Your Black World Coalition to fight against what is happening to Heather. We are reaching out to the Attorney General of the United States, the Attorney General of the State of Missouri, and anyone else who can help this young woman achieve justice. We do not feel that this is the only case in which injustice is occurring, so this is the beginning of a long battle to make our system fair for everyone.

You can sign the petition by following this link:

  1. If she didn't want to go to jail, she could have left the cashier's line when asked to do so, she could have left Walmart when the manager asked her to do so, she could have left Walmart when the police told her to leave or she could have acted in an orderly manner when, after refusing to follow the police's orders, she was arrested. Instead, she chose to resist arrest and fought the police.

Guess what? Assaulting an officer is a serious charge. She isn't facing prison time for cutting in line, so don't trivialize her actions. She is facing prison time for failing to control herself and committing a serious crime!

SHE made the choices which led to her arrest, and we wouldn't even be hearing about this case if she were WHITE! This is a case of a young woman playing the race card because she doesn't want to accept responsibility for HER actions. By jumping to this woman's defense, you are doing a grave disservice to those who actually ARE being discriminated against! Every time race is used to defend those who have no real defense, it desensitizes Americans to cases where race really IS the motivating factor for inappropriate behavior on the part of the police.

This case is not about racism, it's about a young woman with an attitude and an overinflated sense of self, who doesn't think rules apply to her.

  3. Whatever her attitude is/was, because of where she lives and her race the incident is being blown way out of proportion. I for one believe it was racial from the onset. To get the police involved because you perceive someone is breaking in front of line? There are a hell of a lot more important issues in the world. Your place in line is not that friggin criticle. And the fact that the KKK has gotten involve warrants our attention and support.

If she needs to be chastised for this let it come from us.

When are we going to learn true unity as a people? Stand Up! Stand Together! Stand Strong!!! If right, Applaud and Support. If wrong, then Chastise but never turn our backs and ignore.

  4. From what I've just read, it doesn't appear as though it justifies 15 years of jail time. It does require some sense of authority to get her attention.

We should fight against this; it is excessive.

Whenever is see the KKK. It requires us, as supporters of justice, to ensure that there is equity in the law. The KKK is full of ignorance and perpetuates separatism.

We must fight against this and assist her in her interpersonal development.

  5. Cutting a line does not warrant the presence of the kkk, this is ridiculous. If it has nothing to do with race, then why are the kkk there? and the days of being intimidated by the kkk are over anyway, and 15 years for cutting line only happens in America! Is it that the kkk don't think the police is capable of doing their job? why do the police or Walmart need the kkk? I tell you what here's how to solve this mess - choose a day, week, month or more for all people of color not to shop at Walmart!

  6. The KKK's are the one that arrested and prosecuted Miss Heather Ellis Thats the bottom line.

  7. This is something that has been Blowned completely out of line. Sounds to me that racism is playing a big part in this. Come on surely there is something more important in that city going on.Than arresting someone for cutting in line. Hey they cut in line at fairs, malls, movies, etc., It is not the end of the WORLD!!! I am really shock that Wal-mart would even want their name in this ridiculous mess. I will never shop at that Wal-mart. They will never get my business!!!!!

  9. I have seen alot of nonsense in Walmart in fact I have come to expect it! She was obviously insensed by the treatment from the cashier I dont blame her!!!We arent talking about Bloomingdales here.Walmart is a cut throat, greedy, opportunistic company to begin with. Her race was a factor from the start customers in Walmart are notorious for cutting the line, having 75 items in the self checkout, coping attitudes about everything from prices to expired coupons they dont have the police called.Walmart is a disgrace and the fact that this happend I hope brings attention to that fact!!!!!

  11. People of African descent in America and throughout the Diaspora for that matter must begin to seriously educate and reeducate themselves to the absolute reality that racism (White supremacy) will be a permanent fixture within the majority American body politic and society as long as African descendants reside in America. The deception of a Black President has and will not change the conditions of structural racism or economic empowerment, because the established order is structured to rule through him in maintaining the status quo and power in its interest.

Furthermore, we must begin to empower all factions of our community and ethnic group as too neutralize the victimization ourselves by those who continue to oppress and exploit us by building institutions at every level of life that affect us. This unconditionally means that the ideology of unadulterated assimilation and integration will need to be rethought and a more progressive shift toward building group cohesion and a unified base of ethnic cooperation and solidarity both culturally and economically are imperatives for the future. It’s always circumstances like this that “should” bring us into reality. Blacks spend into the high millions if not billions of dollars with the Wal-Mart Corporation in annual revenues, but because we have no economic institutions, we give are financial and human capital to oppressive forces and enjoy it. Boycotting, although may have some limited satisfaction and reward, but the real question remains how do we stop supporting and making the enemy richer indefinite.

I support this Sister from this illegal and criminal attack. Will the Obama administration (the Justice Department) intervene!

  12. And what’s the deal with the KKK? Do they not realize their scare tactics don’t work anymore! They are cowards in every sense of the word; they aren’t any different than those radical groups in Iraq and Afghanistan, with their faces covered and killing innocent people. It is amazing to me that we have soldiers in those countries fighting radicals and trying to find (one) man, (Bin Laden), while the radical people are openly here in these United States, the KKK. African-Americans are aware of their past; and mindful of their present and future. I’ve grown very weary of those animals to be quite blunt.

I hope everything goes well in Heather's case.

  19. It seems to me that the whole town feels that Blacks that live there are beneath them. The Cashier could have used tack when explaining that she couldn't cut in line. Heather would have said, she's with her cousin and everything would have been fine. Instead I believe the cashier grew up in a house that was taught to hate Blacks. Her father probably belonged to the KKK.

I'm so glad Heather stuck up for herself, and hopefully her doing so will help that whole town. She will be in my prayers.

  20. IT AMAZES ME HOW PEOPLE ARE SO EASY TO MAKE THIS YOUNG LADY GUILTY OF RESISTING ARREST AND ALL THIS. HAVE YOU ALL NOT SEEN THE NEWS STORIES WHERE EYE WITNESS TESTIMONY SAYS THE SHE WAS BEGGING AND CRYING AND SHOUTING "I AM NOT RESISTING!!!! AMERICA IS A SAD COUNTRY WHEN YOU CAN HAVE MULTIPLE EPISODES OF POLICE BRUTALITY AGAINST BLACKS AND WHITES, BUT YET AND STILL SHE IS BELIEVED TO HAVE CAUSED A PROBLEM! MANY OF YOU HAVE GONE INTO WAL MART AND GOTTEN INTO SEPARATE LINES AND THEN SWITCHED LINES BECAUSE ONE WAS MOVING FASTER THAN THE OTHER. KENNETT IS A SMALL TOWN WHERE EVERYONE KNOWS EVERYONE AND SOMETIMES PEOPLE HAVE PROBLEMS THERE BECAUSE OF WHO THEY ARE. THIS TIME THEY JUST WENT TOO FAR. KENNETT IS A RACIST TOWN AND HAS BEEN FOR EVER AND IF THEY KEEP GETTING AWAY WITH THIS TYPE OF THING IT WILL NEVER CHANGE! THIS IS NOT THE FIRST TIME FOR THIS TYPE OF THING HAS HAPPENED THERE. ITS JUST THE FIRST TIME THAT SOMEONE HAS TRIED TO DEFEND THE NAME, THEIR CHARACTER, AND MOST OF ALL THEIR LIFE! FELONIES RUIN LIVES! AND THIS GIRL IS NOT DESERVING OF THIS AT ALL!

  22. If I was to cut in line at Burger King, Red Lobster, or JcPenny, would I go to jail? If I choose to speak my opinion and let my voice be heard, would I go to jail? If I want to talk to the manager about the situation, would they kick me out of their business and have me arrested? What had happen to Ms. Heather is sad. Arresting a young lady for something that was juvenile and should have not been made out of proportion. Where is the customer who made a big deal out of this? Is she/he happy now to see another African American to go jail for something stupid!! Or is he/she feeling guilty for what has happen? Regardless of what has occured, this has now affected this young lady as a citizen, as an individual, and as a whole. She will probably have trust issue with other race, and fear to speak up when wrong is wrong.

  23. Let's be very clear. This is about racism. What rules? There are no rules about cutting in line or comingling items at the cash registor or adding items at the cash register. This is wrong and the 15 years the D.A. is asking for is obssesive. Heather is the one whose rights were denied and just because a customer voices their dissatisfaction with the situation does not give them the right to trump her rights as a customer. Walmart needs to fire these employees and the D.A. needs to go get some real criminals to convict.

    ReplyDelete
  24. Prosecuters have too much power, and something needs to happen sytemically to change that fact. They throw five charges at you and offer a plea if you plead guilty to one. It takes courage to say "Bull." Thank you Heather for exposing another racist prosecuter. In the end a lot of your brother and sisters (I'm white) will be set free because of your refusal to play this racist game.

    ReplyDelete
  25. There is nothing worse today October 2009 than to experience the injustice and trauma from this situation. This young woman will recieve my support. Suppossedly, cutting a line should not have warranted the police. Trying to explain to the police your rights as a citizen of that community should not have warranted an arrest. 15 years is just proposterous!!!! I do feel that a "black-out" of African-Americans from putting our consumer dollars into Walmart Stores would give an example that we as Americans of African descent are not the same as we were 40 years ago! Our economic power could close Walmart indefinately!

    ReplyDelete
  26. I agree with Shango. There are two levels of concern that I have. One, the injustice and unequal treatment of minoritites that thrives in a society birthed in a false matrix of equality and christianity AND the ignorance of African American youth and young adults who think that their negative attitutde, brashness, and disrespect will be tolerated because they are 'kepping it real' with themselves. No one has to put up with that poison. It is that poison and media which undoubtedly lures African American youth and young adults to think that in the 21st Century they are equal to the majority society and thus find themselves relegated to the same ole' 'system' of bigger, larger, harder and more extreme consequences for those of color in America. "The SYSTEM exists to penalize us, based on false beleif systems and fear. Yes, let's confront the judicial system which may attempt to trap any of us at any time, and teach our seed not to cross the line: we still have to be better, smarter, and wiser. The answers remains the same, we must stand together recognizing our frailty and our strength; while educating our seed as to what 'good' citizenship looks like, sounds like, and behaves like regardless of living in an unjust society. Who neglected to teach this sister that!? This teaching is done at home, by parents.

  27. We all know had her skin color been different it wouldn't have gotten this far in the frist place I just wish people stop acting like we African -Americans are pulling the race card I wish this wasn't the case and it wouldn't be if we could be treated fairly regardless of color of the skin.Iknow that I've joined family or friends plenty of times in line, as well I've also allowed others to join their party in line come on now half of us would be behind bars or facing time. This case is a waste of taxpayers money.

  28. I visited this site after watching the video to offer my support for Heather. Not that it should matter, but I'm white, and was outraged to hear the cutting in line incident had become a felonious offense. I signed the petition, and still support Heather, but am very curious... What does the following statement mean???

"The events took place in a town near the one in which Rush Limbaugh was born, so there is a long history of injustice toward African Americans."

It's that exact kind of rhetoric that makes people - including African American people - disgusted with Sharpton and Jackson at times. Let's stick with the facts of this case for God's sake. This kind of statement makes support for Heather lose credibility.

I feel as a college student, Heather should have the intelligence to know that when we as Blacks are trying to accomplish something, the odds are always against us.Where is she located that the KKK even got involved. It really is time for our Black people to grow up and learn that we are master pieces and no one can stop us...Only God will fight our battles in this world of total unfairness. If she's living in a state that still feels that Blacks don't have certain rights, then God Bless her. I am a native of N.C., born and raised..Gone for many, many, years...Moved back in 1999..I have never seen anything like this..This city that I live in has never adapted to the freedom cause.Martin Luther King was only a dream to them..and I mean only a dream...To this day in the milenium of 2009..They still have a slave mentality...I'm planning to move out again after 10 years of living here and thinking that freedom had arrived. I found out from personal experiences here in N.C that it was the same as in the early 70's.

A successful boycott of Walmart would have to be pre-planned for a future date or dates with the complete information being distributed by well known radio stations, celebrities and or mailings. 38. Why was the police called in the first place? Ok she cut a line, she isn't the first person to do it and won't be the last. This issue is about race and anyone who says otherwise must be truly blind. Why is she being threatened and why is the kkk getting involved? Very fishy.

  42. Wow, it hurts to hear these uncalled for slams against whites as I read through these responses. But that's how racism works, doesn't it? Through generalizations and assumptions.
Obviously Ms. Ellis was a victim of racism. As an educated woman being threatened and humiliated I don't even blame her for swearing and being frustrated. Who wouldn't be? Of course this kind of nonsense wouldn't happen to a white person, and her eventual arrest and abuse at the hands of the police (having her head banged against the car) is appalling. As is them issuing a warrant for her arrest as a dangerous felon after the fact. Sounds like someone screwed up and now no one wants to back down. I'm not talking about Heather Ellis, I'm talking about those in the legal system. Ms. Ellis is a victim, pure and simple. This small sad little town is lost in a time that has become obsolete to right thinking people. I hope they get their ass kicked.

Out of the Church. Who marched with him? Blacks and whites, etc.
Let's go back to church and unite in Jesus name, my black, white, brown, yellow and red sisters and brothers. We can stopped this satanic maddness in Jesus (Yeshua's name)!

  44. This is not fair, and the KKK have nothing to do with this. I send my support to Heather and everyone else who has experienced police and prosecutor abuse.

However, I believe that this is systematic. Think about it!!??? That is the real injustice that should be overhauled. IF A DEFENDANT IS FOUND GUILTY OR INNOCENT, THEN THERE SHOULD BE AN "OPINION OR JUSTIFICATION GIVEN AS TO WHY/HOW THEY MADE THAT CONCLUSION. This probably will not happen in this case because of all of the attention paid to it, but if there were not the attention it probably could happen. Dr. Boyce please hit me up if you have the chance because this is the big picture that will help everyone out, not just black people. Even the KKK should not be against this proposal.

There should be an amendment which gives every american citizen the right to have an opinion/justification made as to why a verdict was made against them. Are we afraid to pursue an amendment in 2009?? It has been a while since we've had one, and this I do not believe ANYONE should have a problem with other than a group of people wanting to keep the status quo, by coming to the conclusion, of guilty or innocent out the drop of the sky. If not there is not much change that could happen as a result. More of this will continue to happen in places like albany, ga, nashville, tn and beyond. I hope you read this and hold back at me. I know you are a very busy man now a days.

How can it NOT be about race when them ridiculous, cowardice fools (KKK) decided to put their 2 cents into the pot??? No matter what she may have done, we as a people need to get involved and fight for Heather, mainly because of the KKK's involvement. They need to know that they are NOT the final judgment in NOTHING that goes on in this so called, "land of the free"!!!

And for this sheriff to hand her a KKK card, how did he just have one on hand for it to misconstrued as he said?!... Right, because it wasn't misconstrued. This county justice department needs to fire all in the court house and start over with 2009 leaders of america.

  56. Ok, for those of you who are saying this is not about racism you must have never experienced it or no anything about the town of Kennett, Mo. I lived there for years and YES it is very racist. The police are very intimidating and the two groups rarely mix. The Caucasians don't want the African Americans around period and they rarely hide that. Now if the KKK getting involved doesn't tip you off that this is a race issue you must be pretty oblivious to who they are and what they stand for. I do that all the time in line in front of cashiers, managers and police officers and have never been taken to jail. She resisted arrest because she didn't deserve to be arrested. If you were being hassled by the police, wouldn't you get an attitude if you did nothing wrong? There are many crooked cops out there who abuse their authority and this is yet another example.

    ReplyDelete
  57. As a middle aged white guy in the same situation, I might have been told to leave, more likely apologized to though. I expect this kind of thing from Walmart, they have a long record of abusing costumers and employees. Proud to say I've never been in one and encourage others to stay out as well.

YES, IF SHE WAS WHITE THEN THIS WOULDN'T BE AN ISSUE AT ALL BECAUSE THIS WOULD HAVE NEVER HAPPENED!
dude, check yourself. you don't know how racist your whole post sounds. this whole incident is utterly ridiculous. for someone to have to spend 15 years locked up because of racist pricks is something that should capture EVERYONE'S ATTENTION. I'm white and appalled by this story. In no way should the police ever been called and I seriously question the officials in that town for letting this perpetuate into this racist sack of mess. those involved with this injustice should lose their jobs and criminal charges need to follow after. no excuses whatsoever should be made for their pathetic existance.

  63. I agree; let us all unite and boycott Walmart on black Friday. Also, we must support this young lady; let us not forget the struggle of our ancestors and that racism is still present and alive today. They have the KKK, but we have each other; Black peoplelet us please unite. We need to get some celebrities and some big names involved. Let's call Oprah and Obama!!

  65. This makes me sick to my stomach, white people are always trying to play down racism because it doesn't happen to them, they don't want to admit that "their" system is flawed & completely messed up. Some white people help black folk & they are really cool, but these buttheads that are always trying to play on our intelligence are fools themselves, black people are not stupid. We know when someone's trying to play us whether they are black, white, asian, latino, or whatever!!! Stop playing with us, we're not going to take it anymore.

The next time I hear a white person try to play down racism when the KKK is involved I swear I don't know what I'm going to do. You people out there in America had better wake up & smell the coffee. God's people can't be messed with and nothing be done about it. God will chasten them with a mighty hand you won't believe. Keep messing with God's chosen people & see what happens to you. Black folk have held this nation up for years and have been down trodden, lied on, spit on, conspired against by the government and everything else.

America please stop before you anger the true & living God.

  66. The clerk CLEARLY over-reacted! While I don't particularly appreciate it when someone holds a space in front of me, and who knows what the young lady said back or how things escalated, but the police would never have been called if she were white (or even some other race) and the sad, lonely KKK wouldn't have been involved. BOYCOTT Walmart on BLACK FRIDAY....and why is it called BLACK FRIDAY anyway...naw just kidding, but you get my point!.

    ReplyDelete
  67. I have read all of the posts. 1) Walmart probally can't intervine because the DA is pressing the charges. When the DA, state, commonwealth, or whatever takes over a case then no one has a say, charges cannot be dropped (I learned this the hard way). 2)A boycott of WalMart will accomplish what? WalMart donates a lot of money back to the communities and schools (white, blcak, yellow, green). Where there is a Walmart or Target, your community is receiving a donation.
I feel that the cashier and manager of that one store overacted and the DA wanted to make an example of the black lady. This is why the police were called. If is a racist town, of the course the KKK will try and attempt to scare the family. As many have said that does not work anymore. But we do realize that racisim is still alive. One solution to the KKK problem is go round up all of gang members across the nation. Since they want to fight and shoot, let them fight with and shoot at the KKK!

  71. This needs to stop. It may have been solved quickly by just asking her to leave the store. Everyone of all races who don't believe in racism should stop shopping at Wal mart. We all need to boycott every Wal mart in the world. if we don't shop at Wal mart I bet she will not do a single day. The courts don't care about us protesting the courts will still find her guilty. The town seems to be racist that means the people in power are too. Those are the same people who have stock in the Wal mart company. Hit them in the pocket and they'll leave us alone. Ask Rosia Parks.
Remember the boycott of the buses. It will work again.

  72. An unfortunate incident, a young person with no respect for others gets caught, isnt sorry just combative, helping to escalate a pathetic situation. It has turned racial, which is wrong. The majority of references above show that racism is a double edge sword. She did a stupid thing. Then behaved stupidly. Now the race thing is being used to excuse her behavior. Situations like this worsen the racial devide, not close it.

    ReplyDelete
  73. The racism and the racial divide was not started by African Americans in the US , I do believe was created by a certain other group of people. For hundreds of years this group of people have used racism to its fullest to exploit and also used it as a means to develop an uneven playing field and now they want to talk and scorn African Americans about what and who is racist . This shows that instead of being a stand up people they would rather pass the buck as they have always have and continue to do so, I wish they would stand up and take ownership of the issue of racism since they are the ones who created it and excelled at it for so long.

And how did the clerk know that she butted in line,It is definelty racism only a fool could not see this for what it is yes boycott hit the cooperation in its pocket, tell walmart everywhere that this will not be tolerated now or never. We can shop other places let them know who we are.We are a people that demand respect just like the want respect. There is 0 tolerance for such actions and Walmart should be made to pay this family for what they have allowed them to be put through

  75. I don't even know where and how to start, because I had to laugh when I've discovered this, thought it was exaggerated and looking deeper into it; IT IS! Okay, I was born, raised and still live in Germany. Something like this incident could NEVER occur anywhere else in the world but in America and it wonders us around the world that such a big powerful country does not realize how ridiculous this accusation is! It is not only ridiculous it is also shameful and poor that the penal system is even taking the time to deal with this!!! People around the world look at this and are as speechless as I was reading it for the first time! And WHO THE HELL IS KKK? As I already mentioned I am German citizen and I am not white and trust me we learned all about Hitler and I can assure all of you that the KKK has nothing in common with that man at all. How do the KKK even justify their ways and how did they come up with such that stupid name??? In Germany, we still have neo-Nazis but you know what the most of them wouldn't dare doing the Heil Hitler sign! Guess what? Because it is against the law and you could get prison time for that! I was not aware that it is against the law to cut the line anywhere in this world!!! SHE DID NOT BREAK THE LAW! She was aggressive they say, WOW, Who wouldn't lose a little temper getting accused of something so RIDICULOUS. She has just shown that she has pride as an individual! Anyways, somebody has to stop this mess and pursue justice; after all there is nothing to prosecute this woman for. If there is anybody or anything to prosecute and punish it would be the county of the city and 'GREAT' Wal-Mart (Oh gosh I am so glad they do not exist in Germany any longer!). I so hope and pray to God that she will sue and fight for justice! Wal-Mart definitely must get sued and get hurt and the only right way to hurt is to go deep in their pockets! GO GIRL and sue for punitive damages and much more... it's America, right?

  76. I am a white woman who is tired of hearing about women (of any color) getting screwed by Walmart. Walmart won't promote women, and now they want to send a woman of color to jail for FIFTEEN years for allegedly cutting in line?! Next time anyone reading this blog gets the urge to shop at Walmart, think better of it.

Good luck to Heather. She's going to need it--Walmart has armies of lawyers to cover up its discrimination, sexism and racism.

  77. People of color better realize that when you deal with the police you better be compliant because they are looking for any excuse to charge you so you can have a criminal record which will in turn put hindrances and stumbling blocks in your life. She was probably right in the unfairness of the situation but once the police are called especially if you are Black....you lose. Now we may lose a potential doctor because the sister wanted to prove she was right. The deck is stacked against her. We, as Black people better start dealing with encounters with the police and authority another way or we may end up in jail, the new plantation

If anyone of you so called educated people had a brain then you would know that this isnt over her being black, cutting in line, or have anything to do with Wal-Mart!!! You should also know that this case will NOT get her 15 years in prison! The Missouri Statutes show that 15 years is the MAXIMUM amount of time someone could get for Assualting an officer which the facts show SHE DID!!!! If this were any other criminal in the same case in court none of you would even care what happened as long as it wasnt you as the defendent!! come on folks. And just as many have said, if you were short-changed, and treated disrespecful would you jus say oh okay I'll go home...NO! So y should she? I would b pissed if I was treated this way too. And i can give u a laundry list of police brutality. Dont be so naive. WAKE UP please. Say u r not racist. Dont act like their arent ppl that are racist. 83. i will never understand why people think because African-Americans are no longer in chains and fields that we have no problems that associate with our race. This is a serious situation and people are wrting comments saying she had an attitude and that if she were white no one would care. We all know thats a lie because if she were white she wouldnt even be in this situation. How many white people get social visits from the KKK? I mean because if indeed it really were social what is the need for the card with the words " Next Time it will not be social" Come on people the "RACE CARD" is not being played because it is not a game. Getting discriminated against is not okay for any one and im sick of people saying the black people are always playing their race. Get a clue!!!!! Racism does exsist and it always will not just against blacks and white but all ethnicities!

  84. Let us not fool ourselves, racism most definitely still exists. Sometimes it is subtle where you have to read between the lines, at other times it blatantly slaps you in the face to let you know HERE I AM! This particular incident is a disgrace to EVERY American. There should be a line of attorneys willing to handle this case PRO BONO. It is time for more than lip service. We dont need to see anymore people on TV saying "I Am Not A Racist." If we dont call it was it is,we give it permission to remain alive and allow those who choose to, to use it to their advantage. As radical as some of our music is and with the increase in young black "Millionaires" we should invest in the future of our children where it really matters. THERE IS RACISM AND IT AFFECTS ACTORS, ACTRESSES, DOCTORS, LAWYERS; ALL WALKS OF LIFE.
WHICH ONE WILL BE YOUR CHILD?

    ReplyDelete
  85. "This case is not about racism, it's about a young woman with an attitude and an overinflated sense of self, who doesn't think rules apply to her."

Its no surprise that you chose to remain anonymous as your summation of the incident is ludicrous given that you do not have all of the facts.

So, allow me to elaborate for you.

    1. Young lady accused of cutting in line.
    2. Authorities are called.
    3. Authorities arrest victim and accuse her of disorderly conduct and assault on an officer.
    4. She declines prosecutor plea, and he charges her with a felony, punishable of up to 15 years in prison.
    5. Officer's action not seen as overzealous and charges dismissed all parties go home.

Now, Anonymous if you can point to any federal or state law where "overinflated sense of self" is a crime then I relent. However, so far this arrest and prosecution has no reasonable bearing and in many ways may violate this woman's 8th and 14th amendment rights.

In your backwards manner, Anonymous you did point out an underlying racist attitude that has been prevalent in this country since the signing of the Emancipation proclamation. The concept of the "uppity negro" getting what she deserves. In your mind, you believe that even if she stood up for her rights as an American citizen, that she deserved this ill treatment because she got out of her place. Somehow she is less than you, who no doubt would have done the same thing. But, unlike her, you would have been a coward and not stood up for your rights as an American and taken the plea deal. Although you had done nothing more than cut in line at a convenience store.

Anonymous, its because of frightened people like you that the Patriot Act was enacted without a blink of an eye. The Government as long as they are white are never incorrect, or overbearing, or fascist or dictators. You are a disgrace to the principles that founded this country if you feel comfortable with an American citizen being sentenced to jail for 15 years for exercising her rights as a citizen even if that meant talking back to a police officer. Of course, we don't know what the officer said to her but we do know that she was injured when he slammed her against the ground to arrest her.

Black, White Brown or red its time for us to become United against injustice. We are too apathetic to people who are not our own race, or what we feel to be our class. Its a class issue, a wealth issue, and had this young woman been the daughter of a congressman or a senator, or a wealthy businessman would we really be having this discussion?

  88. Ok People. Let me begin by saying it is very important to know the facts before jumping to conclusions. I am first to admitt that I don't know all the FACTS of the case I only know what I have read online. However, I must stress that whatever the case I must say that it is extreme to send a young student with no previous record to prision for 15 years. Seriously, unless it was attempted murder or some major crime I can't see the justice in this.
Also it is being said that the young lady asaulted an officer, now let me pose a question to all of you. If you are innocent and truly know that you are innocent would you go peacefully and without a fight???
I don't know what happened that day in Walmart becasue I was not there, but what I do know is that there comes a point and time that people have to stand up for themselves. No offense to any polices officers, but a policeman is a mere human just like all of us no matter our professions and if I know I am not guilty of the accusation I can't say that I would cooperate with law officials.
I would also like to add to the claim of a false cry of racism, if the Heather Ellis had been the child of a prominent member of that community, would the results have been the same.

Ido think that race played a factor, but I also think that this world is biased, and depending on who you are and who you are associated with no matter your race, the results will be different.

I am going to fly from Washington ,DC and attend the protest because its an injustice, the punishement is too harsh. How could this young lady assault a police officer and if so I am sure she did not do any serious harm. Its just not right and you all know it. Stop making excuses. If anything someone should have sit this young woman down and talked to her instead of prosecuting. I am sure she was very frightened.
To all the supporters, I'll see you November 16.

It's embarassing to me that other countries laugh at us. Here we are as America, this great powerful nation ,which we built, still have petty ass problems and kkk and black panthers and all this other crap. The other countries are saying, "who is kkk and why is this Great America that we respect so much, have these problems so childish. Yes, Im praying for Heather and her family. Im glad she is standing up for herself. In the Marine Corps, we have character as a whole and there are no black and white, we are all brothers at war. Lets not be naive, are there still racist people in our Corps? YES!!!!! If this scenario would've happened to me, i would've done the same thing, but probably worse.kkk you are making us Americans look so bad, my Iraqi-a-likes. You have no idea how retarded yall look in that funny suit that noone is afraid of no more. Point blank, God runs this world and the devil is told be a beautiful angel. This world will soon end, so as of now and right now, everyone needs to make the best of it and live it up and fight for whats right and character does mean alot because for some of us, thats all we have. it got racial when the so called KKK got involved. She is not making it a racial problem, she didnt have to. Blacks are not publishing this crap, the media is. She is just defending herself. the corporate America is televising this, because its a good story. Media, this is someones life we are talking about here. I hope you get your quotas and ratings for this story, Good Luck(with great sarcasm). i know how the game works my people and its alot of uncovered bullcrap in politics and the military government. dont be angry, just prepare for the end, because the government is bringing America down and its alot of jealous countries who hates us and dont no longer need our money anymore coming at us soon, so put on your 3D glasses. and guess what, my remains will probably be left out there for a country who does not appreciate history that made us great today. God spoke, man will destroy the world himself, we are very capable. so its bigger than Heather, she is just one of the victims of the struggle. Lets pray for her and this world. thank you

  95. I mentor women in prison, and at first I was overwhelmed by the stories told to me of offers from prosecutors for long term sentences, when had they chosen to have a "trial by jury" their sentences would have been reduced. Why was this? All of the inmates I've spoken with are poor, uneducated, using public defenders, minorities and running scared-stiff.

Racism would never be extinguished as long as society remains sin-sick; but if wars which began thousands of years ago,and has continued to the present, would we as a people stop fighting? Therefore, we must unite and stand up to this VENOM which permeates our lives, individually and definitely collectively.

I am saddened for this young woman and her family, but in retrospect, I am encouraged that this has happened, because this problem has to surface for the people of this nation and world to raise their voices in unison so the black race can be shown respect and acceptence as citizens of this county.

To the perpetrators, whoever you are remember this: The God who created all of us ,human beings, meant for us to be equal, regardless of color etc. And He DOES NOT LIKE DIRTY! What's good for the "black" sheep, is certainly good for the "white" sheep too.(my deceased mother's statement, towards any kind of injustice.)

The days of slavery is OVER; let it be known. that each one of us have the God-given right to live with our heads held high and be proud that we are the descendants of our ancestors who were enslaved for hundreds of years; their bodies and spirits mutilated, all because of the color of the skin God created them with.

  96. WHERE IS THE VIDEO? We can't accept anyone's word about what happened until we see the video! Perhaps the Walmart employee stretched the truth about what happened. Perhaps the police treated her the way the officer treated the black Harvard Professor. Something happened, but WHAT? Perhaps Heather is not telling all. SO, WHERE IS THE VIDEO? We should be allowed to see what happened in its raw form. There is a very good reason why Walmart has not released this video. Guess why. The jury is out until we can see for ourselves.

Living here in the Missouri Bootheel, (Kennett) and other locations, Black people have been brutalized for so long, they are afraid to help each other because the kkk come after them, Jim Crow has never left, when you try to hire lawyers, you find out the lawyers are working with them. You cant win, and the police lie, lie, lie,. Heather never kicked anyone, he grabbed her and put her in a head lock, she screamed that she ' was not resisting arrest", repeatedly, the other police joined in, and suspended her in the air, while brutality is taking place, anything can happen, she never kicked anybody intentionally, they are lying and that's the truth. Be not deceived.

  99. Heather would have been best served to swallow her hurt pride, because that is all this is, and leave the store let alone the line. This is not an issue worth taking a stand, particularly since she was aware that her environment and neighborhood was one full of racial overtone. Why go into the Lions Den if you know the lion is at home.. Leave well alone and take your business elsewhere. At that point then she could engage the community to stand with her against Wal mart . As it stands she does have a case. She is being charged because of her conduct NOT because she jumped the LINE.

  100. If this would have happened to me, I probably would have done the same thing....and that's scary. My family and friends, myself included have held spaces in line many many times. To the people who think that "we're just whining again" think about how many times you have had someone hold your spot in the grocery store(when you forgot an item)or had someone hold your spot because you forgot something in the car?? This whole thing is ridiculous and it just pisses me off so bad. The cashier has me fuming for even saying anything in the first place & then the manager calling the police.....walmart really needs to check whats going on in that store.
IF the tape shows that she struck the officers, then yes she should be punished, but NOT anything that can give her up to 15 years.

Racism is so bad...I try my hardest not to always assume that just because something happens to us, I cry RACISM....but this is racism at its best!!!!

It appears that since the Republicans want to put fear in the heart of white people regarding African Americans since Obama became president they are aggressively going after us particularly our youth. So, the attitude is get all the minorities you can locked up and for long terms.

Two wrong doesnt make a right but 15 Years for bing disorderly because you are disputing the issue. Abuse and INJUSTICE is not acceptable, no even in the Word in the Bible. This Country will pay for its evil, fighting against abortion but killing innocent people under the guise of fighting terror. How did we get to this point? If the customers were not complaining, the cashier should not have said anything. Once the employee started the commotion, that is when the customers got involved and the police. There are so many Civil Right cases pending against Walmart. This is just one that got out of control. Walmart is at fault for putting this in motion and it should have not gotten this far.

The cost of gas in your neighborhood to the cost of your property taxes has everything to do with race. Also, we all of aware of people like Rush L! The good thing is that he is a constance remember which is good because African Americans should never forget the struggles of our grandparents, parents and all of the people before them!

I sure wish people could use the english language appropriately when they make dumb comments.Furthermore the kkk has nothing to do with this it was fliers some idiot put out there to get stupid humans in an uproar. If this chick had done what she was told there would be no issue. This is just like that jack-ass professor Obamas' buddy did.

  114. Yeah, we gotta see that video to make a judgement - but 15-years in prison for assaulting and threatening a police officer without a weapon is wrong. Maybe 3-years max. if what is on the news is correct.

If she were white, this incident wouldn't have happened. Therefore, it would not have been public knowledge. You fail to realize blacks have been discriminated for so long, there comes a point when one snaps. If blacks just "walked away" on every redundant racial incident, racism would only get worse and it would appear blacks are accepting of it. Once you accept the fact that racism still exists and walk in a black persons shoes, you'll begin to understand most situations. Lastly, Racism is NOT a card. It's a damn diseased condition. Start reading about the struggles of the black race and begin putting yourselves in the shoes of them, come back with a comment.

  117. This is ludicrous and anyone and everyone who acknowledges right from wrong should stand up and support this young lady. We all have had a bad day and stepped outside of the box, but that does not mean that if at the wrong place at the wrong time we all should be slapped handcuffs, and served with 15 years! Forget about race-we all know our color. To rise above Jim Crow, Civil Rights Movements, and KKK we have to come together as one. if she were white-I support you. If she were Asian-I support you. Regardless, she is me as I have done wrong at one point and as easily as she was struck by this lawsuit-so could I have been. We have to remember our pasts, but be better than that and start a new movement and a new day and just unite.

  118. This is obserd. I don't understand why the police was called and how did this line cutting thing esculate? Also why was she being arrested in the first place to gete a resisting arrest charge? We need more info before we start protesting and as far as the KKK those cowards are everywhere you just don't know who they are because they hide under their sheets so don't give them to much credit! I will be praying for you Heather, God has a plan for our lives it looks like the evil one is winning but he is not just wait and see what the ends will bring, they have to answer for this stuff that they do and the earth will open up and they will drop below because there is no answer to justify this!

  119. I am outraged that a Police officer gave this young lady a card with a threat from the KKK. If this is true, the Police Officer and all involved should be prosecuted for violating Heather Ellis' civil rights. I am so outraged by this. I think I need to drive to the court building for the hearing.

  120. She cut in front of people, then started a fight. That is why the police were called. When the police arrived she fought with them too. She was then arrested and rightfully so. Black people need to learn basic manners if they want to be accepted in society. You don't cut in front of people even if you're there with Jesus Christ himself. What makes you think you can do that? Learn some basic respect for your neighbors.

  121. To the last comment that was posted I am a current graduate with my degree in criminal juatice in persuit to become a police officer. Oh by the way I am BLACK and I have plenty of manners I don't think anyone is trying to justifie her cutting in line but their is a place were you draw the line 15yrs I think that is a waste of tax payers money and time. We are already dealing with over crowded prisons. Now we are going to make it worse by locking people up for minor offenses this is a victim less crime so lets see we will let out the child rapiset to make room for her. What about the man that was just arrested for killing other black people and barring them around his property. Shoudn't that hold president over a "line cutter". For the record in the next ten to fifteen years white people will be the minority and Latino will be the Majority so if the roles were reverse and she was white would you feel the same or would you rally behind her. Maybe justice is not for everyone Just the Majority!

  123. A lot of people talk about being racist... U know what? I have been discriminated upon by African-Americans more than by White-Americans for being Eastern European. After years of going to work every day on time, clean and sober I get the boot from the cousin of my Black boss for complaining that he is smoking pot while operating heavy mashinery. That day almost killed me and other 3 workers. Now if U think THIS is fair then probably that spoilled bratt should rot in jail. And her parents should be asaimed for not teaching her to behave in a public place.

  124. Wow.. I can't believe people are actually comin here to post their support for the police that have obviously abused their authority. I'm not so sure the issue started as an issue of race, but by the fact that the KKK has shown their ugly cowled heads, it is now. And yes, she could've left the store. Just as Martin Luther King could've stopped giving speeches, or Rosa Parks could've given up her seat. I'm not saying that is going to be a turning point in American history, but simply, she made a choice. She took a stand against someone making a big deal out of nothing. She took a stand and now she's being accused of worse because of it. Oh, and to anyone that reads this and decides to complain about me, I'm white, so don't try any of the usual racist crap with me.

  127. Just read above comments and agree, "Black" people or anyone regardless of color should support Heather Ellis. Spread the word via internet, flyers, CNN, MSNBC, BET etc. and boycott Wal-Mart. If it happened to her, it can happen to You, me and anyone. White folks in small towns despise intelligent, well educated, informed Black people. This incident is bigger than Heather Ellis...There is more to this than what is being seen. White folks (KKK and other racists) involved in this are ignorant; and are breaking the law by abusing their authority and embellishing the truth. Of course, she resisted, who wouldn't for something like this. Sad but true, some white folks can be dumb as a box of rocks, & will have the nerve to feel they are better than a Black person with a PhD, simply because they are white. If a Black person is educated, smart, assertive, & speaks up, they are "uppity". I’ve shopped at Wal-Mart for years, but now, after this....I'm done, so done, you can stick a fork in me. Wal-Mart will NEVER get another penny from me. As for this whole issue, the racist "clear people" (white folks) in 2009 are mad because Obama has been elected as Commander & Chief not a "yes" man; takes the truth to the people. Some white folks will grin in your face & the minute they don't get what they want, they will turn on you like a snake. Has anyone noticed how bad the economy has gotten? How big corporations are killing our economy, outsourcing jobs to India, China, Mexico, Philippines? Corporate America is getting back at President Obama because 1)he is righting a lot of wrong, 2) revealing to the American people the skullduggery going on between previous administrations, big corporations & Wall Street. 3) bringing peace & accomplishing what previous administrations could not do. Foreign countries view the US in a better light than with the Bush & other administrations with the "cowboy-war" mentality. These white boys have been "stealing & lying" for years, getting away with it. The chickens have come home to roost. As mentioned above, some white folks just don't get it. God is in EVERYTHING, Obama is President, because God allowed it; & as God said "when you do it to the least, you have done it unto me". He will make the crooked road straight; those who are taken advantage of will become the head and not the tail. This nation is in the situation it is in now, because some white folks feel they are "superior" to anyone who is not "white". They have taken God out of everything, want to create life, destroy life, “blow holes in the moon", destroy the environment, rule over the world, create wars, wrongly accuse & imprison innocent people, destroy other countries, take the resources they want all in the name of so called "peace" etc. How long do they think God is going to condone this? The CEOs of ENRON, the Bernie Madoffs and (others that have not yet been caught),Countrywide, BofA, AIG, Morgan Stanley the Illuminati & others that have perpetrated the biggest fraud & rip off of the entire history of the world (destruction of the US economy), have taken the TARP money & gave it out in bonuses to their cohorts, are the "true felons". Causing hardworking people to lose their homes, jobs, retirement, destroying the economy holding the United States hostage. Everyone better WAKE UP AND SMELL THE COFFEE, as to what is REALLY GOING ON, THE HANDWRITING IS ON THE WALL....THIS INCIDENT WITH HEATHER ELLIS 15 YEARS IN JAIL FOR CUTTING IN LINE,,,, IS JUST THE BEGINNING. STAND UP AND FIGHT, when you stand up for HEATHER ELLIS, you are standing UP for yourself, your children & others; as it could very well begin to happen again & again. God Bless & Have Mercy on us all.

  129. This is an injustice. Walmart handled the incident of "cutting in line" inappropriately, it should have been a question of courtesy, not a question of race. If Heather had been caucasian , this issue would have never escalated to the degree in which it did. The police would not have been called, if it had been a white woman to "cut the line". It's
apparent the cashier and manager of Walmart lack communication and conflict resolution skills. Missouri obviously has archaic laws, which should be abolished or are they just enforced when persecution and intimidation are intended? The police used poor judgement when they asked the Walmart manager, What do you want us to do?" Level minded and community oriented police officers would have asked to have a word with Heather and advised her not to "cut the line" in the future and issued a ticket. The entire
incident was totally mismanaged and Walmart should do a better job of educating it's employee's with regard to conflicts. I will reiterate, this entire incident would have never happened if Heather had been caucasian. Unfortunately, old slave master mentality perpetuated this incident, "How dare you nigger, take cuts in line,
I'll show who's the boss... Racism is still very much alive and thriving in the USA...

  131. I'm curious of where this pervasive attitude comes from that postulates black people with attitudes incite civil disobedience. I try very hard to believe that there is a conscious movement in white america that transcends race, but the fact is, there is not now, nor has there ever been one, nor will there ever exist one. The American Negro remains entrenched in guerrilla warfare against an enemy that has with great dominion of every facet of the governing, judicial and financial infrastructure of this nation. 15 years for treaspassing, when she was a paying customer? How can you trespass when you patronize an establishment? What's more why would the prosecution, representing that region offer her a plea deal by trying to coarce her with the indication that a jury deliberation would not favor her? MLK once said that "...the moral arch of the universe is long, but it bends toward justice..." I think thats false, I believe the moral arc of the universe is long but bends toward the sum of its flaws.

  134. Only in Missouri could a minimum wage obviously white cashier refuse to serve a customer because she supposedly "cut line". Any other state, the cashier would do what she was hired to do....ring up Walmart's cheap ass merchandise. That's why WalMart should be boycotted. The surveillance tapes do not prove any resisting arrest or assult of a police officer. Let's admit it, RACISM is very much still alive and well in the United States and is ery much a part of the fabric of the "dirty South". Until you address that, it will be what it is. The Attorney General needs to go to Missouri immediately.

I just find it strange that the employee's involved have been transferred to a different store, and no one from Wal-Mart is commenting on it. I also find it strange that no video shows her assaulting the police. This is not about playing the race card, it's about people being treated the same as others. BLACK OR WHITE.

  139. Just let her go to trial! If she is truly innocent the jury will let her go - if she is guilty beyond a reasonable doubt she gets some time. I don't believe 15 years is right, but maybe 5! She committed several felonies - she assaulted the police. She caused the whole ruckus. She is not charged with cutting in line, she did do that and that was very wrong, but then she escalated the situation. A reasonable person would have gone to the end of the line and nothing else whould have happened. She chose to fight - she was wrong and she is the cause of her own problems. Maybe the judge could sentence her to a mental health facility where she could be treated for her obvious mental illness - then released back to society when she is cured. And to bring out the race card is further proof of her delusions.

  141. First; what right do I have to step in front of another customer. Should it matter why I'm doing it? Or who I'm doing it with? As a matter of fact, it should. For the first few months while living in Japan I was frustrated about how often Japanese people seemed to cut in line. As I became more familiar with the culture I learned the Japanese had such high respect for each other that if someone moved forward in the line it was because they actually had the need to do so. And the rest of the people accepted this as a society because it was rarely abused. Americans are neither that caring, courteous or smart.
If I needed to move quicker, I would ask permission from a person before I got in front of them in a line. Chances are, I wouldn't get turned down (flies & honey..). Why? Because it's the right thing to do. Some people don't know that. I'm a retired Sergeant Major of Marines. Of ALL MY MARINES. I don't care what color, sex, preference, or whatever, people are people. If you can do my job better, you deserve it. If you can do it as good, you deserve to be with me. If you can't, you deserve my help to get better at it. Unless you prove to have a case of won't vs can't. Then you deserve a kick in the pants. Sadly, I all too often feel like one of the disenfranchised mentioned in some of these postings. I'm a white guy who's never oppressed anyone or owned anyone, or ever wanted to. But I am a bit tired of the KKK rhetoric and all too quick musings of Sharpton, Jackson et al, who blame me for things of which I have no involvement while hardly ever pointing their other fingers at people setting horrific examples within their own race to foment hatrid and racism. I wish it wasn't so.
Back to you young lady. If you're innocent, the trial should bear it out. If you had a bad case of the Katrina's that day (I'm from New Orleans too), then you got some splainin to do. And that's all yours.

My PRAYER'S are w/you and your family and I pray that a movement in a Walmart store not for stealing but getting in line w/a cousin does not land no one not even educated Black woman even if you were any other color should be treated as a criminal, today we need to focus on the lost and exploit of babies and the Men and Women who are doing such a touble thing.

Also 15yrs is the Maximum sentence for the crimes she comminted (assaulting a police officer) it does not meen that she would have gotten 15yrs in prison. if she had no priors and was really innocent she would have been fine but she took a deal so obviously she did something wrong in her head

  154. Often times we must realize that there are underlying causes to racism, and this young lady may be being used as a sociological 'scapegoat'. She was angry before she even entered the Walmart store, and they are infamous for instigating racist and sexual harrassment motivated incidents. They often coincide. If her father is a prominent African American professor, and she lived in a racist area (i.e...an area where the KKK had members), then it is quite believable that she was being railroaded into anger. Second and Third party harassment is impossible to prove, and if the officer was associated with the KKK, this makes it almost impossible. Being someone who has lived within the racist Virginia areas, especially during the famed VA Beach riots in the 90's..I know. Also, years ago I worked as a Manager at Walmart. They instigate indirectly, and I feel sorry for her. She should have handled her issued legally, instead of supposedly assaulting an officer. But did you know that spitting or sursing at someone is also considered assault? That's all he did was make her angry & then scapegoated her into trumped up charge. Believe it people. It happens alot more withint he black community, then we would care to admit. This young lady just happens to be an exception, because she is educated enough to 'stand out' in the crow. It's obvious that something is wrong. But, why are we still experiencing this type of racism within the U.S., even after a supposed 'black' President? We should carefully consider the reason why. MO is not the only state with problems. Perhaps..not addressing the problem, is the real issue...not the KKK, the police, Walmart, or the state. Think about it. I'm Alihsa M.
